A global surge in home appliance recalls—most notably involving millions of air fryer models—has placed a glaring spotlight on the hidden dangers lurking in modern kitchens. Who Is Liable When an Appliance Causes Injury?
Before 2011, injured consumers had the uphill task of proving negligence. But South Africa’s Consumer Protection Act No. 68 of 2008, which came into full effect in 2011, shifted the legal burden.
“Today, strict liability applies. You don’t have to prove negligence, only that the product was defective and that it caused harm. That’s a major protection for South African consumers.”

Under Section 61 of the Act, multiple parties can be held liable, including manufacturers, importers, distributors, and retailers. Liability can arise from:
- Supplying unsafe or hazardous goods
- Product failures or hidden dangers
- Inadequate instructions or safety warnings
These protections apply regardless of whether the product was purchased online, in-store, or received as a gift.

What to Do If You’re Injured
If a faulty appliance causes harm, Haslam advises against rushing to accept refunds or exchanges.
“You may be entitled to much more than a replacement appliance. Personal injury claims can cover medical bills, lost income, and pain and suffering.”
